1/ GENERAL

In this data protection declaration, we inform you about the way in which the simplified joint stock company "ÖKO EUROPE", registered with the DIJON Register of Companies in France under SIREN number 848 783 015 and whose registered office is located at ZONE ARTISANALE POUILLY BAS, 9 RUE DE L ARTISANAT, 21560 COUTERNON - France (hereinafter also referred to as "we" and/or "our" and/or "ÖKO EUROPE") processes personal data. In order to provide ÖKO EUROPE services and functions, it is necessary for us to process a certain amount of personal data. Even when you order products, the data required for the purchase and shipment of goods is processed and forwarded as necessary to service providers commissioned by us for the purpose of fulfilling the order. In addition, address and order data are collected and processed for our own marketing purposes. For external marketing purposes, only data whose transmission is permitted under the applicable data protection legislation is passed on.

3/ PROCESSING OBJECTIVES AND LEGAL BASIS

The following paragraphs provide further information on the purposes for which we process personal data and the relevant legal bases.

3-1 Log data

Each time you visit ÖKO EUROPE pages, usage data is transmitted by your Internet browser and saved in so-called "log files". Log files contain the following data: date and time of visit, name of the page visited, IP address, URL referrer (the original URL from which you accessed the web pages), amount of data transmitted, loading time, as well as product and browser version information. Users' IP addresses are deleted once they have finished using our pages.


We evaluate these log file records in anonymized form in order to further improve our offer and make it more user-friendly, to detect and eliminate errors more quickly and to manage server capacities (see also section 6). Log file records are also used to recognize, defend against and prosecute attacks on our offering.


The legal basis for the processing of log data is our legitimate interest in improving our offering and managing our server capacities, maintaining our offering without disruption and complying with our legal obligations to maintain IT security.

3-2 Data processing for the provision of ÖKO EUROPE services

At ÖKO EUROPE, you can create a user account and a personal profile. In order to be able to offer you these features, we need to process data relating to the end device you are using as well as to your person, including your gender, first and last name, e-mail address, user name and password.


When you make a comment, recommendation or assessment about products, brands and styles, we process the personal data you enter as part of the comment or assessment.


In principle, the information you enter can be managed, added to and/or deleted in the profile settings ("Your profile").


We use the above data to provide you with the various features of ÖKO EUROPE, to make you offers tailored to your interests and to contact you.

Insofar as we process data in order to make the various functions available to you, the legal basis is the performance of the contract. In order to be able to provide you with offers tailored to your interests, we process data on the legal basis of "legitimate interest" (we have a legitimate interest in direct marketing to our customers, insofar as this remains within the scope of data protection and competition law regulations). As far as contacting you is concerned, we process data either on the legal basis of "consent" and "performance of contract" (when you have ordered a newsletter) or on the legal basis of "legitimate interest" (when we send you product recommendations by e-mail; see also paragraph 3-5-1).

3-3 Data processing for online purchases

You can also order ÖKO bottles and other products from ÖKO EUROPE against payment. In this respect, we process personal data for the purpose of fulfilling the contract, in particular to process your order, to deliver the goods, to check your creditworthiness, to process payment and in the event of a warranty claim. In particular, we process your first and last names, gender, date of birth, delivery and billing address and e-mail address, as well as your password and telephone number, if applicable.


Your personal data will only be disclosed or otherwise passed on to third parties for the purposes of contract processing or invoicing if this is necessary for contract processing or invoicing, or if you have given your prior consent. In the course of processing your order, service providers appointed by us (e.g. logistics and transport companies).


In addition, we also use the data entered during contract execution or invoicing to be able to make you offers tailored to your interests.


Insofar as we process data for the purposes of contract performance or invoicing, the legal basis is contract performance. In order to be able to provide you with offers tailored to your interests, we process data on the legal basis of "legitimate interest" (we have a legitimate interest in direct marketing to our customers, insofar as this remains within the scope of legal requirements). 

3-4 Making contact

ÖKO EUROPE allows you to contact us in several ways. By e-mail, telephone or post. When you contact us, any personal data you voluntarily make available to us in this context will be used exclusively for the purpose of contacting you and enabling us to process your request.


The legal basis for the processing is the performance of the contract or the execution of pre-contractual measures at the request of the data subject.

3-5 Marketing

3-5-1 Product recommendations by e-mail and SMS

As a customer of our online store, you will receive regular product recommendations from us by e-mail. You receive these product recommendations from us independently of your possible subscription to the newsletter. In this respect, we use the e-mail address entered by you as part of the purchase to promote our own products and/or services which are similar to those you have acquired from us by virtue of an order already placed.


You may opt out of receiving these product recommendations by e-mail at any time by sending an e-mail to info@okoeurope.com and at the end of each product recommendation e-mail, without incurring any costs other than the transmission costs according to the basic rates.


The legal basis for the processing is our legitimate interest in terms of direct marketing to the extent permitted by law.


Marketing texts and notifications (if applicable)

By entering your phone number at checkout and initiating a purchase, subscribing via our subscription or a keyword, you agree that we may send you SMS notifications (for your order, including abandoned cart reminders) and SMS marketing offers. Marketing text messages will not exceed X per month. You may unsubscribe from any further text messages by clicking on the unsubscribe link. The sending of text messages or the use of automations requires you to transmit telephone numbers or names of recipients to our importer. We will store and use this data to show you the analysis and results of the campaign, including message delivery status, sending status and, in some cases, whether the purchase resulted in a sale. If you decide to use our link shortener in text messages, we will collect information on whether or not the link was clicked and use it to display the results in your analytics. Any other third-party services you may choose to use outside the scope of smsbump.com (third-party link shortener, GA tracking, etc.) you will be referred to their specific third-party policies which you must agree to. When sending text messages, we will transmit the data to our text message operator to effect delivery. Information is only shared with our operator when a marketing campaign is initiated. If your recipients no longer wish to receive messages, they must reply to the message with STOP or contact us at the e-mail address below so that we can successfully unsubscribe them.

3-5-2 Newsletter

When you subscribe to the newsletter, your e-mail address is used to send you e-mail advertising. You can revoke your consent at any time and free of charge, with effect for the future, by clicking on the "unsubscribe newsletter" link in the newsletter and then following the instructions given.

The legal basis for processing your e-mail address in order to send you a newsletter you have ordered is the performance of the contract.

3-6 Other purposes

We also process your data for the purposes of asserting, exercising and defending our rights; the legal basis for this is our legitimate interest in safeguarding our rights.

4/ SHELF LIFE

In principle, we retain your data for as long as is necessary for the establishment of this online offer or as long as we have a legitimate interest in further retention (e.g. even after the execution of a contract following order processing, we may still have a legitimate interest in using your data for advertising purposes). Excluded from deletion are exclusively data which we require for the purpose of fulfilling outstanding tasks or asserting our rights and claims, as well as data which we are obliged to retain by virtue of statutory retention periods. Insofar as data is not deleted simply because a retention period still exists, its processing by us is nevertheless restricted, even without your request.

5/ COOKIES

We use cookies on various pages to make your visit to our website more attractive and to enable you to use certain functions. Cookies are small text files that are stored on your computer. Most of the cookies we use are deleted again from your hard disk at the end of the browsing session (so-called "session cookies"). Session cookies enable us to display the shopping basket across pages on the site, where you can see exactly how many items are in your basket and the current value of your purchases.

Other cookies remain on your computer and enable us to recognize your computer the next time you visit (so-called persistent cookies). These cookies are used to make our website more user-friendly, more efficient and safer. Thanks to these files, it is possible, for example, for information specially tailored to your interests to appear on the page. These cookies are automatically deleted after one year.
For this purpose, our cookies capture the following information, among others: Session ID, shopping cart hash, wish list hash, user origin, type of categories visited, last page visited on ÖKO EUROPE.

The legal basis for processing information about our users via cookies is the performance of the contract and our legitimate interest in the user-friendly and secure provision of ÖKO EUROPE services.
Of course, you can set your browser not to store our cookies on your hard disk. The help function in the menu bar of most Internet browsers explains how to prevent your browser from accepting new cookies, how to instruct your browser to notify you when you receive a new cookie, or how to delete or block cookies already received.

To do this, proceed as follows:

In Internet Explorer :

  2. Click on the "Data protection" tab.
  3. Now you can proceed to the security settings for the Internet zone. Here you can set whether and which cookies should be accepted or rejected.
  4. Confirm setting with "OK".

6/ ANALYSIS TOOLS AND INTERNET TECHNOLOGIES

The legal basis for the processing of your data in connection with all analysis tools and Internet technologies is our legitimate interest in analyzing the website activities and the usage or browsing behavior of the ÖKO EUROPE user as well as our interest and the interest of third parties in the insertion of personalized advertising related to the interests of the user.

6-1 Google Analytics

This website uses Google Analytics, a web analysis service provided by Google Inc ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is generally transmitted to and stored by Google on servers in the United States. We have activated an IP anonymization function on this website; in this respect, your IP address will be shortened beforehand by Google in the member states of the European Union or in other states that are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA, where it will be abbreviated.


Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage for website operators. The IP address transmitted by your browser within the framework of Google Analytics and abbreviated before saving is not managed together with other Google data. 6-2 Retargeting

This website uses retargeting technologies which are operated by other providers. Retargeting makes it possible to reach users who have already shown an interest in our store and products with targeted advertising on our partners' websites. Studies have shown that the insertion of personalized advertisements geared to the user's interests is more interesting for the user than advertisements that do not have such a personal connection. In the case of retargeting, advertising media are inserted on the basis of a cookie-based analysis of the user's previous behavior. It goes without saying that no personal data is stored here, and it goes without saying that the use of retargeting technology complies with the applicable data protection regulations. If you do not agree to the use of this form of advertising, you can deactivate cookies and/or delete existing cookies via your Internet browser settings. 7/ SOCIAL PLUGINS

The legal basis for the processing of your data in connection with Social Plugins is the performance of the contract or possibly your consent.

7-1 Facebook, Google and YouTube

Social plug-ins from Facebook and Google (Google+ and YouTube) are used on this website. These are offered by the American company Facebook and Google Inc (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google")).


When you surf to a page containing such a plugin, your browser establishes a link with Facebook or Google and content is downloaded from these pages. Your visit to this website may therefore be tracked by Facebook and Google, even if you do not actively use the Social Plugin function. If you have a Facebook or Google account, you can use such a Social Plugin and share information with your friends. TomorrowDog has no influence on the content of the plugins and the transmission of information.

7-2 Instagram

This website also integrates plugins from the social network Instagram Inc, 1601 Willow Road, Menlo Park, CA, 94025, USA ("Instagram"). The Instagram plugin can be recognized by the "Instagram" button on our page.

If you click the "Instagram" button while logged into your Instagram account, you can link content from our pages to your Instagram profile. Instagram can thus attribute the visit to our pages to your user account. Please note that we have no knowledge of the content of the data transmitted or how it is used by Instagram. 7-3 Disconnection

By logging out of social network pages and deleting installed cookies, you can generally prevent social networks from attributing information collected about you to your user account with the relevant social network during your visit to ÖKO EUROPE. You can also prevent plugins from being downloaded completely by using add-ons for your browser, such as the "NoScript" script blocker at http://noscript.net.

8/ DATA PROCESSING OUTSIDE THE EUROPEAN ECONOMIC AREA

Personal data is not processed in states that do not fall within the scope of Directive 95/46/EC (European Data Protection Directive) or Regulation 2016/679 (General Data Protection Regulation, GDPR), insofar as the service providers named in this data protection declaration or third-party suppliers, whose registered office is established outside the European Economic Area, are not affected. In this case, we ensure prior to transmission, that the recipient has either an appropriate level of data protection (e.g. through self-certification of the recipient for the EU-US Data Protection Shield ("EU-US-Privacy Shield") or the European Union's standard contractual clause agreement with the recipient) or sufficient authorization from our users.


You can obtain from us an overview of the recipients in third countries and a copy of the specific arrangements made to ensure an adequate level of data protection. In this respect, please refer to the information in section 3-4.

9/ YOUR RIGHTS

If you wish to assert your rights as a data subject, please send your request in writing or in text form to our customer service department at info@okoeurope.com or in writing to ÖKO EUROPE, 25 chemin du Barra, 15000 AURILLAC - France. Please enable us to identify you clearly.

Right of access: You have a right to information about the personal data we process about you.

Right of rectification and deletion: You also have the right to have your personal data corrected or deleted at any time, provided that the relevant legal requirements are met. In the event of inaccuracy, we undertake to rectify immediately the data stored by us following a communication made by you. Personal data will be deleted if the legal requirements are met, in particular if the purposes for which the data was collected or otherwise processed are no longer necessary, or if the data has been processed unlawfully. Excluded from deletion are exclusively those data which we require in order to perform outstanding tasks or to assert our rights and claims, as well as data which we are obliged to retain by virtue of statutory retention periods. Insofar as data is not deleted simply because a retention period still exists, its processing by us is nevertheless restricted, even without your request.

Right to restrict processing: Provided that the legal requirements are met, you can demand that we restrict the processing of your data.

Right to object to data processing You also have the right to object to the processing of your data by us at any time. We will then stop processing your data, unless we can prove - in accordance with legal requirements - compelling legitimate grounds for further processing, which take precedence over your rights.

Objectionto direct advertising: You can also object at any time to the processing of your personal data for advertising purposes ("advertising refusal"). However, this does not apply to data required to process your order. Once we have received your objection, we undertake not to use, process or pass on the data in question for any purpose other than fulfilling your order, and we will stop sending you advertising material.
