These general terms and conditions of sale (hereinafter referred to as the "General Terms and Conditions of Sale") are entered into between :
On the one hand, individuals or legal entities wishing to make a purchase via the SAS ÖKO EUROPE website, hereinafter referred to as "the Purchaser ". the Buyer " ;
And, on the other hand, the company ÖKO EUROPE, SAS with a capital of 50 euros, under the trade name ÖKO EUROPE, whose registered office is ZONE ARTISANALE POUILLY BAS, 9 RUE DE L ARTISANAT, 21560 COUTERNON - France.

1/ THE ÖKO EUROPE OFFER
1-1 Geographical coverageProducts sold online on the www.okoeurope.com website are delivered to most countries.
The geographical coverage of each sale may vary according to the distribution agreements of each of the referenced suppliers, as well as delivery methods. ÖKO EUROPE may use "country filters" on the site to block orders from countries not covered by the offer.
The products offered on the www.okoeurope.com website are accompanied by an indicative period of availability and shipping time. This information is updated regularly.
A product mentioned as " in stock " is present in ÖKO EUROPE's own inventory. The actual availability of a product may vary rapidly depending on the sales made on the site or the stock of products at its suppliers.
A product marked " available in x days" means that ÖKO EUROPE will be supplied within this period in working days by its supplier, subject to availability from its suppliers. Errors and changes may occur in exceptional circumstances.
ÖKO EUROPE cannot be held responsible if the indicative availability time of the product(s) and their shipment is modified. In the event that a product is unavailable after an order has been placed, ÖKO EUROPE will contact the Purchaser by telephone or e-mail as soon as possible. The Buyer may choose to maintain his order or cancel it.
ÖKO EUROPE will make the refund by crediting the Purchaser's bank account within fourteen (14) days of payment.
The products offered for sale are described and presented as accurately as possible. However, ÖKO EUROPE cannot be held liable for any errors or omissions in this presentation.
Photographs are not contractual.
Product prices are indicated in euros, including all French taxes, and are firm and final.
They do not include shipping and handling costs related to the Buyer's order, which are invoiced in addition and indicated before the Buyer's order is validated.
ÖKO EUROPE reserves the right to modify its prices at any time without prior notice. Products will be invoiced to the Buyer on the basis of the prices recorded at the time of order validation.
ÖKO EUROPE regularly carries out maintenance work on its website. This may result in pricing errors. In this case, the order cannot be honored and ÖKO EUROPE will contact the buyer to cancel the order as soon as possible.
Products remain the property of ÖKO EUROPE until full payment has been received.
2/ ORDERING PROCEDURE
2-1 Ordering requirementsThe Buyer must have legal capacity or parental authorization to place an order on the www.okoeurope.com website.

The Buyer can place an order via the Internet at www.okoeurope.com.
The data communicated by the Purchaser and recorded by ÖKO EUROPE at the time of the order constitutes proof of the transactions between ÖKO EUROPE and the Purchaser. The validation click after completing the order form constitutes confirmation of the Purchaser's order, and constitutes an electronic signature with the same value as a handwritten signature. It constitutes irrevocable acceptance of the General Terms and Conditions of Sale.
The conclusion of the contract will only be effective after ÖKO EUROPE has sent an e-mail confirming the registration of the order.
ÖKO EUROPE reserves the right to refuse delivery or to honor an order in the event that the Buyer has not paid in full or in part for a previous order, or in the event that a payment dispute remains unresolved.
All orders placed from Monday to Friday (excluding public holidays) are prepared and dispatched within 24 to 72 hours if all products are indicated in stock and subject to payment validation. Orders placed over the weekend are processed no later than the following 3ᵉ working day.
Delivery times apply from the time of collection by the carrier.
3/ PAYMENT
ÖKO EUROPE (www.okoeurope.com) offers various payment options.
All orders, regardless of country of origin, are payable in euros only.
Payment of the full price is due at the time the order is placed by the Buyer, who undertakes to pay the price stipulated for the item(s) ordered, including the price of the item(s), as well as postage and other order processing costs.
As part of the fight against Internet fraud, ÖKO EUROPE reserves the right to request a photocopy of your identity card and proof of address for any payment.
Only payment by one of the following credit cards will be accepted: CB, Visa and Mastercard.
The card is debited when the order is confirmed.
The Buyer guarantees ÖKO EUROPE that he/she has the necessary authorizations to use the card payment method when placing the order.
ÖKO EUROPE makes every effort to ensure the security and confidentiality of data transmitted via the www.okoeurope.com website (including online payment). To this end, the www.okoeurope.com website uses a remote payment system and SSL (Secure Socket Layer) encryption of data, which is never transmitted unencrypted over the network. In addition, the transaction is carried out via the Stripe banking platform, which alone has access to the confidential information (card number, validity date) supplied by the Buyer at the time of payment.
ÖKO EUROPE does not store any bank details.
PayPal is a payment service provider specialized in issuing electronic money between the Buyer and a third party. Paypal ensures the confidentiality of the Buyer's banking information. Thus, the Customer's financial information is never communicated to ÖKO EUROPE. PayPal encrypts and protects the card number. Customers pay online simply by entering their e-mail address and password.
The Buyer guarantees ÖKO EUROPE that he/she has the necessary authorizations to use the card payment method when placing the order.
ÖKO EUROPE makes every effort to ensure the security and confidentiality of data transmitted via the www.okoeurope.com website (including online payment). To this end, the www.okoeurope.com website uses a remote payment system and SSL (Secure Socket Layer) encryption of data, which is never transmitted unencrypted over the network. In addition, the transaction is carried out via the Mollie banking platform, which alone has access to the confidential information (card number, validity date) supplied by the Purchaser at the time of payment.
ÖKO EUROPE does not store any bank details.
Payment by instalments/deferred payment is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
Purchase amount
P2X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
P3X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
P4X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
Fees
By paying in instalments with Alma, the Customer does not pay any fees.
Alma is a telepayment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.
Cancellation
Any termination of the General Terms and Conditions between the Seller and the customer shall result in the termination of the General Terms and Conditions between Alma and the customer.
4/ DELIVERY
Products are delivered to the delivery address given during the ordering process in the destinations mentioned in article 3 above.
ÖKO EUROPE cannot be held responsible for the impossibility of delivery in the event of an error in contact details. In this case, the costs incurred for a new delivery will be borne by the Purchaser and invoiced at their actual cost.
ÖKO EUROPE undertakes to deliver the items ordered as quickly as possible, depending on the delivery method chosen and the availability of the items. The delivery times indicated on the www.okoeurope.com website are the usual average times and correspond to the order processing times.
When the Buyer orders several products at the same time and the shipping times are different, the actual shipping time may be the longest, as the entire order is prepared when all the products that make it up are in stock at ÖKO EUROPE.
Delivery is deemed to have taken place when the product is handed over to the Buyer.
In the event of a damaged parcel, it must be refused by refusing to sign the acknowledgement of receipt and returning the parcel to the delivery person.
The Buyer must file a claim with ÖKO EUROPE by e-mail at info@okoeurope.com, and not with the carrier, within five (5) days following the day of presentation of the damaged package. *
If delivery is delayed or packages are lost, the Purchaser must notify ÖKO EUROPE by e-mail or telephone within ten (10) days of receiving the order confirmation by e-mail. *
* For information purposes, as the time required to investigate with the carrier is beyond ÖKO EUROPE's control, ÖKO EUROPE can only be held liable for its speed in opening a claim file with the carrier and for rigorous follow-up of the file to ensure that the Buyer receives his order within an acceptable timeframe.
If the recipient is absent at the time of delivery, the deliveryman will leave a delivery notice at the delivery address indicated by the Purchaser. The order must be collected from the address and in the manner indicated by the delivery person.
If the order is not picked up within the time limit set by the delivery agent, the order will be returned to ÖKO EUROPE, which reserves the right to refund the price of the order, with shipping costs to be paid by the Purchaser.
When orders are shipped to destinations outside the European Union or French overseas departments and territories, they may be subject to customs duties, local taxes or other charges imposed by the authorities of the destination country. These charges and taxes are calculated and collected directly by the said authorities and do not fall within ÖKO EUROPE's scope of action or responsibility.
Please note that this situation is not specific to ÖKO EUROPE, but generally applies to all imported goods. Customs checks are carried out at random, which means that not all packages are systematically subject to these charges.
For our part, we constantly strive to communicate upstream the precise nature of our products when making export declarations. This transparency goes a long way to minimizing the risk of additional controls or unexpected costs for our customers.
Customers are therefore strongly advised to check with the relevant authorities in their country before placing an order.
5/ RIGHT OF WITHDRAWAL
The Right of Withdrawal is considered to have been correctly applied if the following conditions are fully met:
- Lead time
The Buyer has a period of fourteen (14) clear days from the delivery of his order to notify his wish to cancel without having to justify his decision or pay any penalties, with the exception of the cost of returning the goods.
After contacting customer service, the Buyer has fourteen (14) clear days to return the goods in their original condition.
The period runs from the date of receipt of the product. It is expressed in calendar days.
- Product status
It is imperative that the product be returned in new condition, correctly "protected", in its original, undamaged packaging, accompanied by any accessories and its instructions for use.
No returns will be accepted if the returned products have been visibly used or damaged by the Buyer and this use or damage renders the products unfit for resale.
After contacting customer service, the Purchaser has fourteen (14) clear days to return the goods to ÖKO EUROPE in their original condition and at his own expense.
The return of goods is the sole responsibility of the Buyer and any risk associated with the return of goods (damage, theft, breakage) will be borne by the Buyer. ÖKO EUROPE shall not be held liable for any transportation costs incurred by the Buyer in returning and forwarding the parcel.
Goods returned carriage forward will not be accepted.
Upon receipt of the return package, ÖKO EUROPE checks the conformity of the return. No returns will be accepted if the returned products have been visibly used or damaged by the customer and this use or damage renders the products unfit for sale. If the return cannot be accepted, ÖKO EUROPE will contact the Buyer to return the products at his expense.
Subject to acceptance, ÖKO EUROPE will reimburse the Purchaser as soon as possible and at the latest within fourteen (14) days of receipt of the returned products in its warehouse. The reimbursement will be made to the billing address registered by the Buyer when the order was placed and via the means of payment used to pay for the order.
Please note, in accordance with article L.121-21-4 of law no. 2014-344, ÖKO EUROPE is not obliged to reimburse additional costs related to express delivery. ÖKO EUROPE does not reimburse shipping costs incurred by the Buyer.
Please note: In order to exercise the right of withdrawal, ÖKO EUROPE requests that the Buyer also return items offered as part of a promotional campaign.
6/ AFTER-SALES SERVICE / LEGAL WARRANTIES
The Buyer benefits free of charge from the 30-day guarantee given by ÖKO EUROPE.
ÖKO EUROPE cannot be held responsible for the misuse and/or intensive use of the articles by the customer.
The after-sales service procedure:
- Send a photo, even if the defect is not apparent, and a precise description of the problem by e-mail to info@okoeurope.com, specifying the order number.
- Upon receipt of this information, ÖKO EUROPE will decide whether or not to accept the product(s) for after-sales service.
- ÖKO EUROPE will send you a printable return slip by e-mail.
- The purchaser must send the clean product with the order number. ÖKO EUROPE is responsible for return shipping costs.
- Upon receipt of the return, ÖKO EUROPE will exchange the product(s) by sending a new shipment at its expense.
All products offered by ÖKO EUROPE are subject to the legal warranties of conformity (articles L.211-4 to L.211-14 of the French Consumer Code) and hidden defects (articles 1641 to 1649 of the French Civil Code). To invoke one of these warranties, the Purchaser must contact ÖKO EUROPE by e-mail at info@okoeurope.com, by telephone at +33 (0)3 80 63 51 73 or by registered mail with return receipt to: ÖKO EUROPE, ZONE ARTISANALE POUILLY BAS, 9 RUE DE L ARTISANAT, 21560 COUTERNON - France.
Contractual warranties do not cover :
- Abnormal or improper use of the products. In this respect, ÖKO EUROPE invites the Purchaser to carefully consult the instructions for use supplied with the products,
- Defects and their consequences if the product is used for purposes other than those for which it was intended,
- Defects and their consequences due to any external cause,
- Damage to filter media caused by use prohibited by the manufacturer, such as the filtration of sodas, colas, hot drinks and anything else that isn't water,
- Damage caused by dropping or mishandling by the customer.
7/ RESERVATION OF OWNERSHIP
All orders remain the property of ÖKO EUROPE until full and final payment has been received from the Buyer.
The transfer of responsibility to the Purchaser takes effect as soon as ÖKO EUROPE hands over the package to the carrier.
8/ "INFORMATION TECHNOLOGY AND FREEDOM" LAW
The information requested by ÖKO EUROPE is essential for the management of the Buyer's order. In accordance with the French Data Protection Act of January 6, 1978, the processing of this personal information is subject to a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL) under number 1896934 v 0. The Buyer thus has the right to access, modify, rectify and delete data concerning him/her at any time by contacting ÖKO EUROPE. This right may be exercised by sending a request by e-mail to info@okoeurope.com
Depending on the selection made by the Buyer when creating or modifying his/her account, he/she may receive information and commercial offers from ÖKO EUROPE. The Buyer may at any time decide not to receive such information and commercial offers from ÖKO EUROPE by specifying his request by e-mail via info@okoeurope.com.
9/ INTELLECTUAL PROPERTY
All texts, photos, comments, works, illustrations and images reproduced on the www.okoeurope.com website are the property of ÖKO EUROPE. Consequently, it is strictly forbidden to reproduce, download, copy or exploit them, even partially, for commercial purposes, anywhere in the world, without the prior consent of ÖKO EUROPE.
10/ LIABILITY
The products offered on www.okoeurope.com comply with current French legislation and standards.
ÖKO EUROPE cannot be held responsible for the non-performance or improper performance of the contract concluded between the parties in the event of force majeure, the occurrence of an event attributable to the customer or any foreseeable and insurmountable inconvenience or damage inherent in the use of the Internet.
ÖKO EUROPE cannot be held responsible for any indirect damage that may arise from the purchase of products.
The photographs, graphics and descriptions accompanying the products are not contractually binding and ÖKO EUROPE cannot be held responsible for them.
As the www.okoeurope.com site is hosted by an external service provider, ÖKO EUROPE cannot be held responsible for any interruption of the site's service, the occurrence of bugs, inaccuracies or omissions concerning the information available on the site, or for any damage resulting from fraudulent intrusion by a third party having altered the information on the site.
For all stages of access to the site, consultation, filling in forms, placing orders, delivery of items or any other service, the company ÖKO EUROPE has only an obligation of means. Consequently, ÖKO EUROPE cannot be held liable for any inconvenience or damage inherent in the use of the Internet (loss of data, files, etc.) and totally external to the diligence and precautions taken by ÖKO EUROPE.
ÖKO EUROPE accepts no responsibility for the content of sites to which hyperlinks are provided from its own site, as it has no control over their content.
11/ APPLICABLE LAW - DISPUTE RESOLUTION
The present General Terms and Conditions of Sale shall be executed and interpreted in accordance with French law. In the event of a dispute, the parties shall seek an amicable settlement before taking any legal action.
For this purpose, ÖKO EUROPE requests the purchaser to contact its customer service department by e-mail at info@okoeurope.com.
It is agreed that French law shall apply.
