Preamble
These general terms and conditions of sale (hereinafter referred to as "general terms and conditions of sale") are agreed between:
On the one hand, natural or legal persons wishing to make a purchase via the SAS ÖKO EUROPE website,hereinafter referred to as " the Buyer ";
And, on the other hand, the company ÖKO EUROPE, SAS with capital of €50, trading under the name ÖKO EUROPE, whose registered office is located at ZONE ARTISANALE POUILLY BAS, 9 RUE DE L ARTISANAT, 21560 COUTERNON – France.

1/ THE ÖKO EUROPE OFFER
1-1 Geographic coverage of the offerProducts sold online and presented on the website www.okoeurope.com are delivered to most countries.
The geographical coverage area for each sale may vary depending on the distribution agreements of each of the listed suppliers and the delivery methods. ÖKO EUROPE may use "country filters" on the website to block orders from countries not covered by the offer.
The products offered on the website www.okoeurope.com are accompanied by an indicative availability and shipping time. This information is updated regularly.
A product listed as " in stock " is available in ÖKO EUROPE's own inventory. The actual availability of a product may vary rapidly depending on sales made on the website or the inventory of products at its suppliers.
A product marked "available in x days" means that ÖKO EUROPE will be supplied within this period in business days by its supplier, subject to availability from its suppliers. In fact, errors or changes may occur in exceptional cases.
ÖKO EUROPE cannot be held liable if the estimated availability date of the product(s) and their shipment is changed. In the event that a product is unavailable after an order has been placed, ÖKO EUROPE undertakes to contact the Buyer as soon as possible, by telephone or email. The Buyer may choose to maintain their order or cancel it.
ÖKO EUROPE will make the refund by crediting the bank account no later than fourteen (14) days after payment by the Buyer.
The products offered for sale are described and presented with the greatest possible accuracy. However, ÖKO EUROPE cannot be held liable for any errors or omissions that may occur in this presentation.
The photographs are not contractual.
Product prices are indicated in euros, including all French taxes, and are firm and final.
They do not include shipping costs and other processing fees related to the Buyer's order, which are charged as extras and indicated before the Buyer's order is confirmed.
ÖKO EUROPE reserves the right to modify its prices at any time without prior notice. Products will be invoiced to the Buyer based on the prices recorded at the time of order confirmation.
ÖKO EUROPE regularly carries out maintenance work on its website. This may result in pricing errors. In such cases, the order cannot be fulfilled and ÖKO EUROPE will contact the buyer to cancel their order as soon as possible.
The products remain the property of ÖKO EUROPE until they have been paid for in full.
2/ ORDER PROCEDURE AND TERMS AND CONDITIONS
2-1 Conditions for placing an orderThe Buyer must have legal capacity or parental authorization allowing them to place an order on the website www.okoeurope.com.

The Buyer may place their order online via the website www.okoeurope.com.
The data provided by the Buyer and recorded by ÖKO EUROPE when placing the order constitutes proof of the transactions between ÖKO EUROPE and the Buyer. Clicking to confirm after completing the order form constitutes confirmation of the Buyer's order and constitutes an electronic signature with the same value as a handwritten signature. It shall constitute irrevocable acceptance of the General Terms and Conditions of Sale.
The contract shall only be deemed concluded once ÖKO EUROPE has sent an email confirming registration of the order.
ÖKO EUROPE reserves the right to refuse delivery or fulfill an order in cases where the Buyer has not paid for a previous order in full or in part, or in cases where a payment dispute remains unresolved.
All orders placed Monday through Friday (excluding holidays) are prepared and shipped within 24 to 72 hours if all products are in stock and payment has been validated. Orders placed during the weekend are processed no later than the third business day following the order date.
Delivery times are calculated from the moment the packages are picked up by the carrier.
3/ PAYMENT
ÖKO EUROPE (www.okoeurope.com) offers various payment methods.
All orders, regardless of their country of origin, are payable in euros only.
Payment of the full price is due upon order by the Buyer, who undertakes to pay the price stipulated for the item(s) ordered, including the price of the items, as well as shipping costs and other order processing fees.
As part of the fight against Internet fraud, ÖKO EUROPE reserves the right to request a photocopy of your ID card and proof of address for all payments.
Only payment by one of the following credit cards will be accepted: CB, Visa, and Mastercard.
The card will be charged when the order is confirmed.
The Buyer guarantees ÖKO EUROPE that they have all necessary authorizations to use the card payment method when placing an order.
ÖKO EUROPE takes all necessary measures to ensure the security and confidentiality of data transmitted on the website www.okoeurope.com (including online payments). To this end, the website www.okoeurope.com uses a remote payment system and SSL (Secure Socket Layer) data encryption, which means that data is never transmitted unencrypted over the network. In addition, the transaction is carried out via the Stripe banking platform, which is the only entity that has access to the confidential information (card number, expiry date) provided by the Buyer at the time of payment.
ÖKO EUROPE does not store any bank details.
The Buyer guarantees ÖKO EUROPE that they have all necessary authorizations to use the card payment method when placing an order.
ÖKO EUROPE takes all necessary measures to ensure the security and confidentiality of data transmitted on the website www.okoeurope.com (including online payments). To this end, the website www.okoeurope.com uses a remote payment system and SSL (Secure Socket Layer) data encryption, which means that data is never transmitted in plain text over the network. In addition, the transaction is carried out via the Mollie banking platform, which is the only entity that has access to the confidential information (card number, expiry date) provided by the Buyer at the time of payment.
ÖKO EUROPE does not store any bank details.
Payment in installments/deferred payment is available through our partner Alma. Payment security is provided by Alma and its service providers. All payments are protected by 3D Secure.
Purchase amount
P3X: Only purchases between €100 and €2,000 are eligible for payment with Alma.
Expenses
By paying in installments with Alma, the Customer does not pay any fees.
Alma is a remote payment manager and issues an electronic certificate that serves as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.
Termination
Any termination of the GTC binding the Seller and the customer shall result in the termination of the GTCU between Alma and the customer.
4/ DELIVERY
Products are delivered to the delivery address specified during the ordering process to the destinations referred to in Article 3 above.
In the event of an error in the address details, ÖKO EUROPE cannot be held responsible for the inability to deliver. In this case, the costs incurred for a new delivery will be borne by the Buyer and invoiced at their actual cost.
ÖKO EUROPE undertakes to deliver the items ordered as quickly as possible, depending on the delivery method chosen and the availability of the items. The delivery times indicated on the website www.okoeurope.com are average times and correspond to the order processing times.
When the Buyer orders several products at the same time and the shipping times are different, the actual shipping time may be the longest time, as the entire order is prepared when all the products that make up the order are in stock at ÖKO EUROPE.
Delivery is deemed to have been made upon delivery of the product to the Buyer.
In the event of a damaged package, it must be refused by refusing to sign the acknowledgment of receipt and returning the package to the delivery person.
The Buyer must submit a claim to ÖKO EUROPE by email at info@okoeurope.com, and not to the carrier, within five (5) days of the date of delivery of the damaged package. *
If there is a delay in delivery or if packages are lost, the Buyer must notify ÖKO EUROPE by email or telephone within ten (10) days of receiving the order confirmation by email. *
* For information, as the investigation times with the carrier are beyond ÖKO EUROPE's control, ÖKO EUROPE can only commit to opening a claim file with the carrier quickly and to rigorously following up on the file so that the Buyer receives their order within an acceptable time frame.
If the recipient is absent at the time of delivery, the delivery person will leave a delivery notice at the delivery address provided by the Buyer. The order must be collected from the address and in accordance with the terms specified by the delivery person.
If the order is not collected within the time limit specified by the delivery company, it will be returned to ÖKO EUROPE, which reserves the right to refund the purchase price, with the shipping costs remaining the responsibility of the Buyer.
When orders are shipped to destinations outside the European Union or French overseas territories, they may be subject to customs duties, local taxes, or other charges imposed by the authorities of the destination country. These fees and taxes are calculated and collected directly by the said authorities and are not within the scope or responsibility of ÖKO EUROPE.
It should be noted that this situation is not specific to ÖKO EUROPE, but generally applies to all imported goods. Customs checks are carried out at random, which means that not all packages are systematically subject to these fees.
For our part, we constantly strive to communicate in advance about the precise nature of our products when making export declarations. This transparency greatly helps to minimize the risk of additional checks or unexpected costs for our customers.
Customers are therefore strongly encouraged to check with the relevant authorities in their country before placing an order.
5/ RIGHT OF WITHDRAWAL
The Right of Withdrawal is considered to have been correctly applied if the following conditions are fully met:
- Deadline
The Buyer has a period of fourteen (14) clear days from the delivery of their order to notify their wish to withdraw without having to justify their reasons or pay penalties, except for return shipping costs.
After contacting customer service, the Buyer has fourteen (14) clear days to return the goods in their original condition.
The period begins on the date of receipt of the product. It is calculated in calendar days.
- Condition of the product
The product must be returned new, properly "protected" in its original undamaged packaging, accompanied by any accessories and its user manual.
No returns will be accepted if the returned products have been visibly used or damaged by the Buyer and this use or damage renders the products unsuitable for resale.
After contacting customer service, the Buyer has fourteen (14) clear days to return the goods to ÖKO EUROPE in their original condition and at their own expense.
The return is carried out under the sole responsibility of the Buyer and any risk associated with the return of the goods (damage, theft, breakage) shall be borne by the Buyer. ÖKO EUROPE cannot be held liable for any transport costs incurred by the Buyer when returning and resending their package.
Returns of goods sent freight collect will not be accepted.
Upon receipt of the returned package, ÖKO EUROPE will check that the return complies with the terms and conditions. No returns will be accepted if the returned products have been visibly used or damaged by the customer and this use or damage renders the products unsuitable for sale. If the return cannot be accepted, ÖKO EUROPE will contact the Buyer to return the products at their expense.
Subject to acceptance, ÖKO EUROPE will refund the Buyer as soon as possible and no later than fourteen (14) days after the date of receipt of the returned products at its warehouse. The refund will be made to the billing address registered when the Buyer placed the order and via the payment method used to pay for the order.
Please note that, in accordance with Article L.121-21-4 of Law No. 2014-344, ÖKO EUROPE is not required to reimburse any additional costs associated with express delivery. ÖKO EUROPE does not reimburse any shipping costs incurred by the Buyer.
Please note: In order to exercise their right of withdrawal, ÖKO EUROPE asks the Buyer to also return any items received as part of a promotional offer.
6/ AFTER-SALES SERVICE (ASS)/LEGAL WARRANTIES
The Buyer benefits from a free 30-day warranty provided by ÖKO EUROPE.
ÖKO EUROPE cannot be held liable for misuse and/or intensive use of the items by the customer.
The procedure for potential after-sales service coverage:
- Send a photo, even if the defect is not apparent, and a detailed description of the problem by email to info@okoeurope.com, specifying the order number.
- Upon receipt of this information, ÖKO EUROPE will decide whether or not to accept the product(s) for after-sales service.
- ÖKO EUROPE will send you a return slip by email to print out for returning the product.
- The buyer shall return the product in clean condition, accompanied by the order number. Return shipping costs shall be borne by ÖKO EUROPE.
- Upon receipt of the return, ÖKO EUROPE will exchange the product(s) by sending a new shipment at its own expense.
The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it occurred.
Where the contract for the sale of goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee shall apply to that digital content or digital service throughout the period of supply provided for. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it occurred.
The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, at no cost and without significant inconvenience to them.
If the item is repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests repair of the goods, but the seller insists on replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract and receive a full refund in exchange for returning the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° Repairing or replacing the goods would cause significant inconvenience to the consumer, particularly where the consumer would have to bear the full cost of returning or collecting the non-compliant goods, or would have to bear the cost of installing the repaired or replacement goods;
4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or termination of the contract when the lack of conformity is so serious that it justifies immediate price reduction or termination of the contract. In this case, the consumer is not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to cancel the sale if the lack of conformity is minor.
Any period during which the goods are immobilized for repair or replacement suspends the warranty that remained in effect until the repaired goods were delivered.
The above rights result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
A seller who acts in bad faith to obstruct the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal warranty against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are retained, or a full refund upon return of the goods.
All products offered by ÖKO EUROPE are subject to the application of legal guarantees of conformity (Articles L.217-3 to L.217-14 of the Consumer Code) and hidden defects (Articles 1641 to 1649 of the Civil Code). To implement one of these guarantees, the Buyer must contact ÖKO EUROPE by email at info@okoeurope.com, by telephone on +33 (0)3 80 63 51 73, or by registered letter with acknowledgment of receipt to the following address: ÖKO EUROPE, ZONE ARTISANALE POUILLY BAS, 9 RUE DE L ARTISANAT, 21560 COUTERNON – France.
The contractual warranties do not cover:
- Abnormal or improper use of the products. ÖKO EUROPE therefore urges the Buyer to carefully read the instructions for use provided with the products.
- Defects and their consequences related to use that is not in accordance with the product's intended purpose,
- Defects and their consequences related to any external cause,
- Damage caused to the filter media by use prohibited by the manufacturer, such as filtering sodas, colas, hot drinks, and anything other than water.
- Damage caused by a fall or mishandling by the customer.
7/ RETENTION OF TITLE
All orders remain the property of ÖKO EUROPE until full and final payment has been made by the Buyer.
The transfer of responsibility to the Buyer is effective from themoment the Buyer or a third party designated by the Buyer takes physical possession of the goods.
8/ DATA PROTECTION ACT
The information requested by ÖKO EUROPE is essential for managing the Buyer's order. In accordance with the French Data Protection Act of January 6, 1978, the processing of this personal information is subject to a declaration to the French Data Protection Authority (CNIL) under number 1896934 v 0. The Buyer therefore has the right to access, modify, rectify, and delete data concerning them held by ÖKO EUROPE at any time. They may exercise this right by sending their request by email to info@okoeurope.com.
Depending on the selection made by the Buyer when creating or modifying their account, they may receive information and commercial offers from ÖKO EUROPE. The Buyer may decide at any time to no longer receive this information and commercial offers from ÖKO EUROPE by specifying their request by email via info@okoeurope.com.
9/ INTELLECTUAL PROPERTY
All text, photos, comments, works, illustrations, and images reproduced on the website www.okoeurope.com are the property of ÖKO EUROPE. Consequently, it is strictly prohibited to reproduce, download, copy, or exploit them, even partially, for commercial purposes anywhere in the world without the prior consent of ÖKO EUROPE.
10/ LIABILITY
The products offered on www.okoeurope.com comply with current French legislation and standards.
ÖKO EUROPE cannot be held liable for the non-performance or poor performance of the contract concluded between the parties in the event of force majeure, the occurrence of an event attributable to the customer, or any inconvenience, foreseeable damage, or insurmountable difficulty inherent in the use of the internet.
ÖKO EUROPE cannot be held liable for any indirect damages that may arise from the purchase of products.
The photographs, graphics, and descriptions accompanying the products are not contractually binding and therefore do not engage the responsibility of ÖKO EUROPE.
As the website www.okoeurope.com is hosted by an external service provider, ÖKO EUROPE cannot be held liable for any interruption in the website's service, the occurrence of bugs, inaccuracies or omissions in the information available on the website, or for any damage resulting from fraudulent intrusion by a third party who has altered the information on the website.
For all stages of accessing the site, consulting, filling out forms, placing orders, delivering items, or any other service, ÖKO EUROPE has only an obligation of means. Consequently, ÖKO EUROPE cannot be held liable for any inconvenience or damage inherent in the use of the Internet (loss of data, files, etc.) and totally beyond the diligence and precautions taken by ÖKO EUROPE.
ÖKO EUROPE accepts no responsibility for the content of any websites to which hypertext links may refer from its own website, as it has no control over their content.
11/ APPLICABLE LAW - DISPUTE RESOLUTION
These General Terms and Conditions of Sale shall be executed and interpreted in accordance with French law. In the event of a dispute, the parties shall seek an amicable agreement in priority to any legal action.
ÖKO EUROPE asks its buyers to contact its customer service department by email at info@okoeurope.com for this purpose.
It is agreed that French law shall apply.
12/ CONSUMER MEDIATION
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, ÖKO EUROPE SAS is a member of the Consumer Mediation Center of Judicial Conciliators (CM2C).
In the event of a dispute that cannot be resolved amicably with our customer service department, consumers may refer the matter to the consumer ombudsman free of charge:
